These Terms of Service ("Terms") govern your use of Kinly, an AI-powered friendship and community connection service. By using Kinly, you agree to these terms.
Service Description
Kinly provides:
- AI-powered conversational companion services
- Local activity and business search functionality
- Community connection features
- Privacy-first data handling
Age Requirements
You must be at least 17 years old to use Kinly. By using our service, you represent that you meet this age requirement.
Account and Usage
Account Responsibility:
- You are responsible for maintaining the security of your account
- Provide accurate information during signup
- Use the service in accordance with these terms
Usage Limits:
- Connect Plan: 30 messages per 5-hour window, 1 activity search per month
- Community Plan: 70 messages per 5-hour window, 6 activity searches per month
- Kinfolk Plan: Unlimited messages, 8 activity searches per month, 3 human connections per month
- Usage windows reset every 5 hours, monthly limits reset on your signup date
Acceptable Use
You agree not to:
- Use Kinly for illegal activities
- Attempt to harm, abuse, or harass others
- Share inappropriate, offensive, or harmful content
- Attempt to reverse engineer or hack our services
- Use the service to spam or distribute malware
- Violate any applicable laws or regulations
AI Service Disclaimer
Important: Kinly uses AI technology that can make mistakes. You should:
- Verify important information independently
- Confirm business details before visiting locations
- Use your own judgment for personal decisions
- Not rely solely on AI advice for critical matters
Activity Search Disclaimer
Our activity search feature provides information about local businesses and events. We cannot guarantee:
- Accuracy of business hours or contact information
- Current availability of services or events
- Quality or safety of recommended activities
- That businesses are still operating
Always verify information before visiting any location or attending any event.
Privacy and Data
Your privacy is important to us. Please review our Privacy Policy to understand how we handle your data. Key points:
- Conversations are stored locally on your device
- We only collect anonymous usage analytics
- Individual messages are processed by AI services temporarily
- You control your personal data
Payments and Refunds
Billing:
- Community Plan subscriptions are billed monthly at $12.99
- Kinfolk Plan subscriptions are billed monthly at $19.99 (coming soon)
- Payments are processed securely through Stripe
- Usage limits reset according to their respective schedules regardless of payment date
Refund Policy:
- No Refunds: All sales are final. We do not offer refunds for any paid plans
- Immediate Access: Since you receive immediate access to paid features upon payment, all purchases are non-refundable
- Digital Product: As Kinly is a digital service with instant delivery, refunds are not available under any circumstances
- Cancellation: You may cancel your subscription at any time to prevent future charges, but no refund will be issued for the current billing period
- Service Continues: After cancellation, you retain access to paid features until the end of your current billing period
Service Availability
While we strive for high availability, we cannot guarantee uninterrupted service. Kinly may be temporarily unavailable due to:
- Maintenance and updates
- Technical issues
- Third-party service outages
- Force majeure events
Limitation of Liability
To the maximum extent permitted by law, Kinly and its operators are not liable for:
- Any indirect, incidental, or consequential damages
- Decisions made based on AI-generated content
- Issues with third-party businesses or services
- Data loss (though we encourage regular backups)
Intellectual Property
Kinly respects intellectual property rights:
- Our service and technology are protected by applicable laws
- You retain rights to your personal conversations and data
- Third-party AI services have their own terms and policies
Changes to Terms
We may update these Terms from time to time. When we do:
- We'll notify you via email or in-app notification
- Continued use indicates acceptance of new terms
- Material changes will include a notice period
Termination
Either party may terminate your use of Kinly:
- You can stop using the service and delete your account at any time
- We may suspend or terminate accounts that violate these terms
- Upon termination, your local data remains on your device
- Paid subscriptions continue until the end of the billing period
Beta Service Notice
Beta Status: Kinly is currently in beta testing. This means:
- Features may change or be discontinued
- Service may have bugs or limitations
- Your feedback helps improve the service
- We appreciate your patience as we develop
Governing Law
These Terms are governed by the laws of the jurisdiction where Kinly operates. Any disputes will be resolved in accordance with applicable law and jurisdiction.

If any part of these Terms is found to be unenforceable, the remaining portions will continue to be valid and enforceable.
